Terms of Use

1. Accepting these terms

These Terms of Use are an agreement between you and Ferocia Sports Corp., which operates FEROCIA Sports Center in Boca Raton, Florida ("FEROCIA", "we", "us"). They apply when you use ferociasports.com, the FEROCIA Player Portal (players.ferociasports.com), our emails and our online store (together, our "services"). By using our services, or by checking the box when you create a Player Portal account, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use our services.

2. Your Player Portal account

• You must be 18 or older to create a Player Portal account.
• Each person may have one account, for themselves only. Don't create an account for someone else or share your account.
• The details you give us — name, date of birth, phone and email — must be true and your own. Please keep them up to date.
• You sign in with a one-time code or link sent to your email. Anyone who can read your email could sign in as you, so keep your email account secure and sign out on shared devices.
• Tell us right away at contact@ferociasports.com if you think someone else has used your account.

3. Linking your player record

When you create an account, we try to connect it to your existing FEROCIA player record so you can see your ladders and results. If the details don't clearly match, a staff member reviews the request first. We may approve, decline or ask you for more information, and we may undo a link that turns out to be wrong. Claiming someone else's player record is not allowed.

4. Public results

By taking part in FEROCIA ladders, tournaments and events, you understand that your name, rankings, scores and results may be shown publicly on our website, for example on the Ladder Hub and tournament results pages, and that photos or videos of club events may be published. Your contact details are never made public. The Privacy Policy explains this in more detail, including how to contact us if you'd prefer your name not to appear.

5. Using our services

Please use our services fairly and respectfully. You agree not to:

• pretend to be someone else, or give false information to get access to a player record;
• use bots, scripts or automated tools to create accounts, sign in, submit forms or copy content from our services;
• try to get into accounts, data or parts of the system you're not allowed to access, or test our security without written permission;
• interfere with or overload our services, or get around any security feature (including the "are you a person?" check);
• send messages through our forms that are abusive, harassing, unlawful or spam;
• use our services for any unlawful purpose.

6. Store purchases

Payments in our online store are processed securely by Stripe; we never see or store your card number. Prices, shipping costs and product availability are shown before you pay and may change at any time. We may cancel an order and refund you if an item is unavailable or a price was shown in error. 7. Emails

If you have a Player Portal account, we'll send you emails you need to use it, such as sign-in codes and updates about your account. Newsletters and event news are sent only if you subscribe, and you can unsubscribe at any time with the link in every newsletter.

8. Playing at the club

These terms cover our website and online services. Playing pickleball and taking part in club activities involves physical activity and a risk of injury. Your participation at the club is also covered by the club's rules and any waiver or registration terms you agree to. If those documents and these terms conflict about on-court activities, those documents apply.

9. Our content

The FEROCIA name, logo, website design, text, photos and videos belong to FEROCIA or the people who licensed them to us. You may view and share our pages for personal, non-commercial use. Please don't copy, sell or reuse our content or branding for any other purpose without our written permission.

10. Other websites and services

Our services link to and use services run by others — for example Instagram, YouTube and Stripe. Those services have their own terms and privacy policies, and we aren't responsible for them.

11. No guarantees

We work hard to keep our services available and our standings and results accurate, but we provide our services "as is" and "as available". To the extent the law allows, we don't promise that they will always be available, error-free or secure. If you see a mistake in your results, let us know and we'll look into it.

12. Limits on our liability

To the extent the law allows, FEROCIA and its owners, staff and partners are not liable for any indirect, incidental, special or consequential damages, or for loss of data, arising from your use of our online services. For any other claim about our online services, our total liability is limited to the greater of the amount you paid us for the item or service involved in the claim in the last 12 months, or US $100. Some laws don't allow these limits, so they may not all apply to you.

13. Suspending or closing accounts

We may suspend or close a Player Portal account, or decline to link a player record, if these terms are broken, if the information given is false, or to protect our members or our services. You can ask us to close your account at any time by emailing contact@ferociasports.com. Sections 4, 9, 11, 12 and 14 continue to apply after an account is closed.

14. Florida law

These terms are governed by the laws of the State of Florida and applicable U.S. federal law. Any dispute about these terms or our online services will be handled in the state or federal courts located in Palm Beach County, Florida, unless the law requires otherwise. Before going to court, please contact us — most problems can be solved with a conversation.

15. Changes to these terms

We may update these terms from time to time. We'll change the "Last updated" date at the top, and if a change is significant we'll let you know by email or in the Player Portal. If you keep using our services after a change, you accept the updated terms.
